Terms of Service & User Agreement

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Property Owner,” or “Tenant”) and StaywiseSpaces (“we,” “us,” or “our”), governing your access to and use of https://staywisespaces.in and related software applications (the “Platform”).

By registering an account, logging in via Google OAuth, or using any feature of the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.

2. Nature of Service (Intermediary Status)

StaywiseSpaces is a cloud-based Software-as-a-Service (SaaS) property management tool designed to help paying guest (PG) accommodations, student hostels, and co-living operators organize bed inventory, log tenant contact information, calculate monthly rent dues, and track operational expenses.

3. Account Registration & Security

• Eligibility: You must be at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872.
• Account Integrity: You agree to provide true, accurate, and current information. You are solely responsible for safeguarding your login credentials and for all activities that occur under your account.
• Unauthorized Access: You agree to notify us immediately at support@staywisespaces.in if you suspect any unauthorized access or security breach.

4. Subscriptions, Fees & Payments

Certain features of the Platform (such as multi-property command centers, elevated bed capacity tiers, and automated reminder workflows) require a paid subscription.

• Pricing Tiers: Fees are charged based on the total bed capacity pool or chosen plan (e.g., Monthly or Annual subscription). All displayed plan prices are inclusive of applicable Goods and Services Tax (GST).
• Payment Processing: Payments are processed securely via authorized third-party payment aggregators (including Razorpay). We do not store sensitive payment card details or net banking passwords on our servers.
• Renewals: Subscriptions renew according to the chosen billing cycle. We provide advance in-app notifications prior to any subscription expiry.
• Refunds: All refund requests are governed by our dedicated Refund & Cancellation Policy.

5. Property Owner & User Warranties

If you are a Property Owner or Manager using the Platform, you warrant and agree that:

• Legal Compliance: Your hostel, PG, or accommodation complies with all applicable local, municipal, state, and police regulations (including GHMC trade licenses, fire safety norms, and tenant police verification where required).
• Tenant Data Consent: You have obtained all necessary consents from tenants before entering their names, phone numbers, and rental terms into the Platform, in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act).
• Rental Transactions: The actual lease, rent amount, security deposit, and living conditions are strictly a private contract between you and your tenants. StaywiseSpaces is not a party to any tenancy agreement.

6. Limitation of Liability

To the maximum extent permitted by applicable Indian law, StaywiseSpaces, its founders, directors, employees, and affiliates shall NOT be liable for:

• Any indirect, incidental, punitive, or consequential damages.
• Any loss of rental income, unpaid tenant dues, property damage, or theft occurring at a property.
• Any physical dispute, personal injury, health issue, or food safety matter arising at a hostel or PG.
• Any temporary service interruption, network latency, or third-party server downtime.

In any event, our total aggregate liability arising out of or related to these Terms or the Platform shall be strictly limited to the total subscription fees paid by you to StaywiseSpaces in the three (3) months immediately preceding the event giving rise to the claim, or INR 1,000, whichever is lower.

7. Intellectual Property Rights

The Platform, including its software code, UI design, trademarks, logos, algorithms, and brand assets, is the exclusive intellectual property of StaywiseSpaces. Users are granted a limited, non-exclusive, non-transferable, revocable license to access the Platform solely for their internal property management operations.

8. Account Termination & Suspension

You may terminate your account at any time via your account settings. We reserve the right to suspend or terminate your access immediately without notice if you violate these Terms, engage in fraudulent activities, or use the Platform in a manner that harms other users or violates Indian law.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of the Republic of India. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts located in Hyderabad, Telangana, India.
