1. Introduction

StaywiseSpaces (“we,” “us,” or “our”) operates the website https://staywisespaces.in and related mobile applications (collectively, the “Platform”). This Privacy Policy & Terms of Use document describes what personal data we collect, how we use it, and the legal terms that govern your use of the Platform.

By accessing or using the Platform, you agree to be bound by this document in its entirety. If you do not agree, you must discontinue use of the Platform immediately.

2. Data We Collect

We collect only the minimum data necessary to provide our service:

• Account Information: Name, email address, and phone number provided during sign-up via Google authentication.
• Property Data: Hostel/PG name, city, area, room configurations, bed assignments, and vacancy status — entered by property owners.
• Tenant Records: Tenant name, phone number, monthly rent amount, security deposit, and move-in/move-out dates — entered by property owners.
• Financial Records: Rent payment statuses (paid/pending) and expense entries (category, amount) — entered by property owners.
• Usage Data: Standard web server logs (IP address, browser type, pages visited) collected automatically by our hosting provider (Vercel).

⚠️ We do NOT collect Aadhaar numbers, PAN numbers, government ID documents, biometric data, bank account details, or payment card information.

3. How We Use Your Data

• To provide and maintain the Platform’s core functionality (room tracking, rent management, expense logging).
• To display publicly listed PG/hostel vacancies on the “Find a PG” search page (only when a property owner explicitly opts in via the “Public Vacancy” setting).
• To authenticate your identity and prevent unauthorized access.
• To communicate with you regarding service updates, if necessary.

We do not sell, rent, trade, or share your personal data with third-party advertisers or data brokers under any circumstances.

4. Third-Party Service Providers

We use the following third-party services to operate the Platform:

• Clerk (clerk.com) — Authentication, session management, and user identity verification.
• Turso / LibSQL (turso.tech) — Secure, encrypted database hosting for all property and tenant records.
• Vercel (vercel.com) — Website hosting, SSL/TLS encryption, and CDN delivery.
• Google (google.com) — Google Sign-In for authentication.

Each third-party provider processes data in accordance with their own privacy policies. We encourage you to review their respective policies.

5. Data Security

We implement industry-standard security measures including, but not limited to:

• HTTPS/TLS encryption on all data in transit.
• Strict multi-tenant data isolation — each property owner can only access their own data.
• Server-side authentication and authorization on every data operation.
• Security headers (HSTS, X-Frame-Options, X-Content-Type-Options, Referrer-Policy, Permissions-Policy).
• No storage of passwords in our database — authentication is fully managed by Clerk and Google.

🔒 Important: While we take reasonable precautions to protect your data, no method of electronic storage or transmission over the Internet is 100% secure. We cannot guarantee absolute security and shall not be held liable for any unauthorized access, data breach, or data loss that occurs despite our reasonable security efforts.

6. Data Retention & Deletion

We retain your data for as long as your account is active and as reasonably necessary to provide the Platform’s services. You may request deletion of your account and associated data at any time by contacting us at staywisespaces@gmail.com. Upon receiving a valid deletion request, we will permanently delete your personal data within 30 days, except where retention is required by applicable law.

7. Your Rights Under Indian Law (DPDP Act, 2023)

Under the Digital Personal Data Protection Act, 2023 (DPDP Act) and the DPDP Rules, 2025, you have the following rights as a “Data Principal”:

• Right to Access: You may request a summary of the personal data we hold about you.
• Right to Correction: You may request correction of inaccurate or incomplete personal data.
• Right to Erasure: You may request deletion of your personal data, subject to legal obligations.
• Right to Grievance Redressal: You may raise a complaint regarding our data practices by contacting us at staywisespaces@gmail.com. We will respond within 30 days.
• Right to Nominate: You may nominate another individual to exercise your data rights on your behalf in the event of your death or incapacity.

8. Consent

By creating an account on the Platform, you provide your free, specific, informed, unconditional, and unambiguous consent to the collection, storage, and processing of your personal data as described in this policy. You may withdraw your consent at any time by deleting your account or contacting us at staywisespaces@gmail.com. Withdrawal of consent will result in the termination of your access to the Platform.

10. User Responsibilities

• Property Owners: You are solely responsible for the accuracy of property listings, tenant records, rent amounts, and expense entries you input into the Platform. You represent and warrant that you have lawful authority to manage the properties listed and that all tenant data you enter has been collected with proper consent.
• Tenants: You are solely responsible for verifying property details, landlord identity, and rental terms before entering into any agreement. StaywiseSpaces does not verify, endorse, or guarantee any property listing.
• All Users: You agree not to use the Platform for any unlawful purpose, to upload false or misleading information, to attempt unauthorized access to other users’ data, or to disrupt the Platform’s operations.

11. Public PG Listings Disclaimer

The “Find a PG” search feature displays listings created voluntarily by property owners who have opted to make their vacancy information public. StaywiseSpaces does not:

• Verify the physical existence, legality, or safety of any listed property.
• Guarantee the accuracy of vacancy counts, pricing, or availability.
• Endorse, recommend, or guarantee any property owner or listing.
• Act as a broker, agent, or intermediary in any rental transaction.

Users are advised to independently verify all property details, visit the property in person, and exercise due diligence before making any financial commitment. StaywiseSpaces shall not be liable for any loss, damage, fraud, or dispute arising from reliance on information displayed in public listings.

12. Governing Law & Dispute Resolution

This document shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with the Platform shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

13. Children’s Privacy

The Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal data from children. If we become aware that a child under 18 has provided us with personal data, we will take immediate steps to delete such information.

14. Changes to This Policy

We reserve the right to update or modify this Privacy Policy & Terms of Use at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Platform after any such changes constitutes your acceptance of the revised terms.
